A friend and I (we're both 30) are going on vacation to Mexico at the same place and time as her younger sister and a group of her friends (high school graduation trip). We are not going to be their chaperones - her sister mentioned the travel agent may still have good rates on this particular package, so we booked. We now believe some of the kid's parents think we are chaperones. Can we be held responsible even though we have not agreed to be chaperones? Are we legally responsible for any one who is 18? Is there anything we can do to protect ourselves or would we need to cancel our trip to be safe?

Well of course it is possible that you may be held legally responsible depending upon the circumstances involved. Although you are not guaranteeing the kids' well being, if you are an adult in charge, you are assuming some responsibility. Many people in this situation ask the kids' parents to sign a written waiver along with a specific power of attorney form authorizing you to obtain medical treatment for any of the kids should the need arise. The waiver may not in fact be legally enforceable, but it does no harm.
