This is a good place for the Lamento doctrine. The Lamento doctirne says that in cases where there is damage but muddied liability, courts are most likely to find that the party that has already opaid is liable and cannot recoiver formt he others. If no one has paid the injure dparty, then the possible party wioth the most insurance coverage, or most easily accessable policy will be found to be liable.
