Legal Question in Personal Injury in Missouri
Car Accident
I was recently involved in an auto accident
in which a driver rear-ended my vehicle. I
suffered a cut above my left eye. At the
time of the accident, I told the police I was
not wearing a seat belt. But now I don't
remember whether I was or not. If it wasn't
wearing a seatbelt, am I entitled to recover
damages under Missouri Law.

Re: Car Accident
Prior to August of last year, the most your recovery could be reduced was 1%. Tort reform changed that to 50%

Yes, you are allowed to recover even if you weren't wearing a seat belt. It might reduce your recovery slightly, but won't eliminate it.
