Legal Question in Personal Injury in Missouri

Employee Assaults Patron

I was assaulted by an employee of a bar/restaurant. Serious injuries such as broken nose, lacerations, swelling, etc. It required a trip to the emergency room. The owner of the establishment says that the employee was not on the clock when he assaulted me, he was just a patron. What recourse do I have against the restaurant and the employee?

You may have a cause of action against the establishment, and you may have a cause of action against the employee. Whether the employee was "on the clock" at the time of the assault may or may not affect the owner's liability if they knew or had reason to know that this man would start trouble.

You should probably talk to an attorney about this situation.
