Legal Question in Personal Injury in Missouri

Insurance offer

I was rear ended by 2 cars on Oct 30, 2002 and the insurance company is now ready to settle and is only offering to pay me 50%. How can they even think that is acceptable when my medical bills are over 3000.00? Is this normal? What is the staue of limitations to file in Missouri? I am so tired of fighting this I am ready to get a lawyer to do it for me. Can I make the insurance company pay fees and costs of the lawyer instead of taking it out of my settlement? If not what is the normal percentage?

The answer to your question "is this normal," unfortunately, is yes. Lately, the insurance industry has been hard hit by losses, both in the stock market and from the 9/11 and related claims. They are therefore trying to squeeze out as much profit as they can, and one way to do this is to unfairly refuse to pay claims.

The insurance industry is a numbers game. If they know that 1-2% of claimants will never follow through on their injury claims, they can save millions of dollars by denying all claims, and then paying 98% fairly.

As for making them pay your attorney fee, unfortunately, the answer is no. However, hiring a qualified, experienced trial attorney will help you get the best possible recovery, and paying a fee to get you the full value of your claim is usually better than taking half or a third of the fair value of what you have lost.

The statute of limitations for an automobile crash injury in Missouri is 5 years, but you should not wait that long to hire an attorney if you are going to do so. The longer you wait, the more difficult it becomes to take statements and gather evidence to prepare your case.
