Property damage suit as a result of an automobile accident

So, I need some advice please, here are the facts of the case that I know. My fiance was just served with a summons for a civil litigation case concerning a car accident he was involved in May 2006. At the time he rear-ended a car while they were both turning at a stop light. The driver in front of him stopped abruptly because of birds in the road she claims. This caused him to rear-end her. She suffered paint sratches to her bumper but his car was completely totalled and had to be towed. Now, all this time later they want to sue him for property damage in excess of $2,200 sustained by her car. There is no way paint damage can equal that. Furthermore, the accident report states that the accident was no-fault. At the time, my fiance's insurance policy had lapsed, but he paid to have it reinstated covering the time of the accident. So I guess my question is, what are our chances of coming out of this successfully, I know we need to hire an attorney, but I just don't know if it's worth it if we are going to have to pay the amount anyways. Also, do we need to involve his insurance company and shouldn't they have been taking care of this in the first place? Please let me know any advice you have. Thanks.
