Legal Question in Personal Injury in Missouri

If someone runs a red light and hits someone coming out of a parking lot, why is the person he hit at fault? Trust me, its unavoidable. He sped through there so fast that I could not even see him until we collided and I got the ticket.

These cases are always very fact specific and the legal consequences often depend upon the nature and extent of the "proof". Were there any witnesses? How far from the red light did the collision occur? Can we show that the light was, in fact, red when the other driver went through it? What are the specific damages to the vehicles? If you are concerned about the ticket you were issued, you are entitled to a trial. But, in most cases it is less expensive and less risky to negotiate a plea bargain that avoids a conviction. If the other driver makes a claim against you for property damage or personal injury, you do not want to have a conviction, or even a plea of guilty on the ticket. And, you should decline to make any statements to his or her insurance company if they should contact you requesting "your side" of the case. You probably should consult with an atttorney.
