Legal Question in Personal Injury in Missouri

school bus wreck

My son injured his right shoulder in a school bus accident. It was the other persons fault and she had basic libility. Six kids were hurt, mine being the worse, with a permnant shoulder injury--according to doctor no surgery available at this time, although he is covered until he is 26 on this injury.My question is how does a person determine the value of this kind of injury? He couldn't play football anymore, he stopped hunting because it hurt him too much, he wanted to go into the army when he turned 18 and he couldn't. So basically all his dreams were haulted by this. I have never been involved in something like this, he is 18 now but he wants me to handle everything.

Let me try to answer your questions as much as possible. In a lawsuit, your son would be able to recover his past and future medical expenses and lost wages, if any. If he has been permanently injured, your attorney would hire an expert to determine how that injury will affect the rest of his life and what it will cost. Your son can also receive compensation for the pain he has had to endure. Since the value of your son's case is a mixture of expenses that have a price tag (lost wages, medical bills, etc.) and expenses that do not have a price tag (not playing football, pain, etc.) it is hard to determine exactly what your son's case is worth at this point.

Here is something very important to think about. Because of tort reform that was recently passed in Missouri, the laws that affect your son's case will be changing on August 28, 2005. These changes will make your son's case significantly more difficult to win. Your son's case will also be worth less money.
