Hi. I am an injury attorney out of St. Louis that focuses heavily on two types of cases: slip and fall cases, and car accident claims. When injuries occur on the premises of another, as has happened in your situation, you are entitled to payment of all past and current medical bills, future expenses related to treatment of your injuries, and a just and fair amount for pain and suffering. You are also entitled to any lost wages for time missed from work due to the injuries. In order to obtain a settlement, the adjusters from the insurance companies will need to review your medical records, generally going back several years, and up to the present day. The fact that you had 2 separate falls will become known to the adjusters. The adjuster for the 2nd accident will point to the 1st accident as the cause of all of your injuries, or most of them. And, not surprisingly, the adjuster for the 1st accident will make legal and medical arguments that your injuries are due to the 2nd accident primarily. With this type of situation, I can guarantee you will benefit substantially from having an attorney assist with the claims. Injured people who retain attorneys typically receive over 2 times the settlement amount as those who try to handle the negotiation process without counsel. It is not too late to have an attorney step in on this, but I would not delay at all. The reason I say this is because there is a lot of preparation that an attorney has to do before they enter the negotiation process, in order to maximize the settlement for you. It can take 1-2 months to collect and summarize medical records. An attorney then will put together a detailed "demand package" that will make legal and factual arguments to the adjusters. You are likely entitled to separate compensation for each fall, but it is a situation where you most certainly would benefit substantially from having an attorney handle. There is no up-front fee whatsoever and consultations are completely free. These types of cases are handled on a contingency fee, meaning the attorney only receives the fee when you settle the case. For your convenience, you can reach me by e-mail (weekends and evenings are completely acceptable) at [email protected] or phone at (314) 471-5585. Thank you.
