Legal Question in Personal Injury in Missouri

My truck was hit and i dont have insurance anymore.

My truck was hit while i was driveing down an ally.The other car was at fault,but my insurance was already gone. Am i out of luck,or do i have some rights.

As you know, Missouri law requires you to carry at least the minimum amount of liability insurance on your vehicle. If police resonded to the accident, or if you are pulled over driving without the required insurance, there is an excellent chance that you will receive a ticket.

Regarding your "rights", you may certainly make a claim for damages, or personal injury if you were hurt, against the other driver and his insurance carrier. The fact that you did not have insurance does not effect this right. However, if the other driver claims that you were at fault, you may be exposing your personal assets to collection in the event that the other driver sues you and prevails.

Finally, in the event the other driver sustained damages, finds that you had no insurance and reports this to the D.O.R., your license will be suspended for one year. If, that happens, you can have you license reinstated by going through the proper procedures. Please consult with an attorney if you have not already done so.
