Legal Question in Real Estate Law in Missouri
There are 4 names on a deed for 32 arces of property. If none of them want to buy me out can I put the land up for sale?
1 Answer from Attorneys
No, it would take all four property owners to sign off on any transfer of the property. If that is not possible, you may need to file a lawsuit seeking a Court Ordered Partition of the property. Usually upon the filing of a Suit in Partition, the property owners will come to some agreement because of the cost involved with litigation. But, if not, the Court may order the property sold and the proceeds divided between the parties according to their respective legal interests. Sometimes a letter from an attorney prior to the filing of a lawsuit will encourage everyone to cooperate and find a solution. I do handle this type of matter. If you do not already have an attorney, you may call me for a consultation.
