Legal Question in Real Estate Law in Missouri
My 18 y/o sisters are being evicted from a residence they shared with my mom for 'non-payment' -mom is not being evicted though she has not paid the rent. When mom signed the lease they were 17 after their birthday they signed an occupancy agreement. They graduated from highschool in May and moved in with other familiy members. They did not have jobs until June, it was never understood they were financially responsible for the residence as they were dependents. They are currently enrolled in college - which I believe still makes them dependents. They have not lived at property for 3 months. What are their options to keep this eviction from going on their records? What other options do they have?
1 Answer from Attorneys
They should contact the landlord (or their attorney) and formally relinquish possession of the premises. Then they should file an answer stating that the plaintiff is not entitled to a Judgment for possession, because possession wasn't an issue to be decided by the Court.
