Legal Question in Real Estate Law in Missouri

Adverse Possession Law

What is the statute in Missouri describing the length of time one must have possession to file for ''adverse possession''. Also, if an owner HAS adverse possession, say of a fence, does that adverse possession transfer to a new owner when the property/home is sold?

Re: Adverse Possession Law

I believe that the time period you are asking about is ten years. However, there are several other elements which you must satisfy in order to take title under a theory of "adverse possession". If, in fact, you do satisfy all of the required elements, you do not automatically own the property, or the fence in your example. You will need to file a lawsuit referred to as a "quiet title action" in order to have the Court determine the legal ownership question.
