Legal Question in Real Estate Law in Missouri

breaking a lease

recently I broke a lease, I gave notice and vacatted the premisis. I told him I would be back in two weeks to get my things when I returned the locks were changed and my things had been thrown out. He is sueing me for the broken lease. How much am I liable and can I sue him for my loss of property without being evicted?

Re: breaking a lease

Under the facts that you described, you may have a cause of action against the landlord for the loss of your things. The amount you would be liable for under the lease, for breaking the lease, is best answered by looking at the wording of the lease itself. Do you have your copy?

How did you give notice that you would return in two weeks to get your stuff? How much time did you have left on your lease? Were you current on your rent when you left?

Good Luck,

Tony Smith
