Legal Question in Real Estate Law in Missouri

We are currently under contract on a home with a back up offer. The seller marked NO on the seller's disclosure for plumbing issues. We had a sewer inspection performed by a worker who previously did an inspection for the seller. He told us the seller KNEW of plumbing issues but this was not disclosed. We asked for them to fix and/or pay and they said no. When we try to push our realtor to negotiate, she reminds us there is a full price back up offer on the house and she "says" the back up offer buyers are also aware of plumbing issue and are willing to proceed with the home should we back out. We really want the house- do we have any recourse at this point? No legal ramifications for lying on the sellers disclosure form?

If you don't want the house, with the plumbing issue, don't buy it. You can raise the issue of the false disclosure, but you now know about in time to decide whether to buy.

Good luck
