Legal Question in Real Estate Law in Missouri
We currently have a contract on a home and were scheduled to close on June 23rd. They stated in the seller disclosure that we received 30 feet of water front for dock space and the permit had been paid for. Come to find out yesterday, we do not get a dock space. There is no more room for anymore docks according to AmerenUE. Therefore we are cancelling the contract because having a lake house with no where to put our boat is not what we want. Are we entitled to any earnest money back due to this false statement in the seller disclosure? Not to mention the lock in fees I have paid and appraisal fees. I would of never even looked at the house if it did not have a dock.

It may be possible to get the earnes tmoney back. But, the appraisal costs may not be refundable, unless the appraiser volunteers to waive or refund theri fee.
