If a deed states that said premises are free and clear from any encumbrances, who has to pay the back property taxes owed?

If it is a warranty deed, then the seller may be liable to the buyer for any back taxes that had already been placed as a lien. If the taxes were just due, then maybe not. Of course, a wise buyer has title insurance, which should cover back taxes not explicitly excluded from the policy.
