Legal Question in Real Estate Law in Missouri
Disclosure Fraud
Is there any way that i could get a recission of the sale of my house if I can prove that the sellers disclosed nothing on the disclosure form and in a couple of places covered up damage to our home so our inspector would not find it. Everything in this house is bad. Plumbing, roof, wiring, and the central heat and air. I have found records where sellers were given money to repair a leaking roof 2 years before this house was put on the market and I have had 2 plumbers acknowledge that the plumbing in this house has not worked right since the day it was built. I also have written knowledge from the sellers themselves that they knew the heat and air did not work but they chose not to disclose it. I have also discovered that the wiring is backwards in most of the house meaning that any light fixtures or appliances that are wired directly into the circuits must be done in reverse of their wiring codes.
So do I have a chance of getting out of this? Or am I stuck with this mess? If you could tell me where I could look up some precedents on this matter in MO I would sure appreciate it.

Re: Disclosure Fraud
There is not enough information inyour posting to tell you yet whether you could rescind the sale. If you did not purchase the property "as is" then you were due accurate and fair disclosures. Assuming that you did not sign away such rights, you could seek redress from "your" inspector. If they are bonded, you could get teh titems that they failed to catch repaired on their dime.
You may be able to rescind the sale, or get money damges from the seller, the inspector, the broker, or possibly others.
Good Luck
