earnest money
We signed a contract to build a house in 2004 in August. Long story make short. The builder has so many financial problems that postpone in finishing our house. Until February 2006, we gave up and wanted to look for another house. We hired a lawyer and wrote the builder to sign they would get us out of the contract and agreed to return our earnest money on June 15,2006, if not we will have the right to take him to the court and he is liable for the court expenses. On June 15 we tried to call the builder and he said he doesn't have the money. My question is how is our chance to take him to the court and get the earnest money back?

With the information you provided here it is impossible to determine the possible success of a lawsuit.
You should either consult the attorney who wrote the demand letter about this, or consult another attorney as soon as possible.
