Eviction Law & Process

I Have A tenante who has not paid his last months rent and I have spoke to him several times and he keeps telling me he is going to bring it to me but never does. I just want to get him out as this is an ongoing problem. What is the eviction law

Your question does not say whether you have a written lease. If so, the terms of the lease govern. If not, your tenants are considered "month-to-month", which means that you must give them thirty days written notice to vacate the premises. Most of the time this is done by certified mail so that you will have the signed card as proof that they received the notice. If they are not out on time, you can file a suit in the county where they reside and the Court will issue a Judgment in your favor for possession of the property. You may also obtain a Judgment for any rent due to you. If the tenants do not move out within ten days from the date of the Judgment, you may obtain the assistance of the sheriff's department in having them removed from your property.
