Legal Question in Real Estate Law in Missouri
My father in law left us his 1981 manufactured home and 2 acres of property in a Beneficiary Deed. However, he stilled owed $39,000. We have been paying the monthly bill online to the mortgage company for almost a year. We can't get any information about the mortgage because our name isn't on the account. We can go through the paperwork to do that but do we want to? My question is what happens if we walk away? Can the mortgage company come after us for payment because we are the beneficiary deed holders? What is our responsibility here?
1 Answer from Attorneys
If you have made no agreements with the lender, you may owe them no money. It would be worth your while to see what encumbrances (liens, etc.) are listed on the title. You did not day how long ago he passed. The creditor has a year to open an estate for the decedent they can hi after the manufactured home and possibly other estate assets you may want to conduit directly with an attorney, who can examine the relevant documents.
Good luck
