my father passed away, my mother can not afford the mortage and if she sells the house it is not worth what she owes the only solution we can think of is to let it be forclosed on. But she is afraid that she will be sued, can she be sued for her house being forclosed on? Is there any other options she could consider to get out of the house its in pretty bad shape.

It matters very much whether your mother is on the note or deed to teh house. If she is listed, than she is liable for the debt, and she can be followed to pay off any unrecovered amount. But that is unlikely. If she is not listed, than she may not be followed, although the lender may be able to come after your father's estate. How long ago did he pass away?
