Legal Question in Real Estate Law in Missouri

A friend of mines mother died with out a will, so there is no executor of estate. But on the papers it says dot it goes to her son. The morgage company started the fore closer of the house three days after she died and they had been told the day of her death. They tried to talk to the morgage company, but they told them that the morgage company would only talk to them, if they were the executior of the estate. They told the morgage company that there is no executor, so the morgage company told them to get a lawyer. So can they do that, and do we need an attorney and how much is it going to cost us.

Missouri doesn't have Executors. Their called Personal Representative (PR). Your friend can apply to open an intestate (no will) estate, and be named PR. This will put them in charge of the house and other assets. Your friend should consult directly with a probate attorney, in their or their mother's area, very soon. Time isn't on their side.
