Legal Question in Real Estate Law in Missouri

The HOA is raising dues more than double this year and in our bylaws and declaration it states that the dues are "one mill per annum per year of individual property square footage." This is on file with the county and is it possible to charge more dues than what our founding documents state?

Whether the HOA can raise fees dn dues is usually determined by the bylaws that pertain to the power of the board to set fees. The dues are usually addressed somewhere else. The real question, "can they enforce the new higher fee?" by court action or lein.
