Homeowners Association

We have some serious issues in our subdivision with unsolved repairs, including DNR issues with our sewer system. We are concerned that if our subdivision is released to the Homeowners Association that we will be liable for the repairs and not the developers. There is a person in our subdivision that has signed a form from our developers attorney that sounds to me like she has taken over the subdivision from the developers and is acting as the homeowners association. Can she do this without others consent?? If the subdivision has been released to the the Homeowners Association would she be liable herself for the repairs. If a subdivision is released to a Homeowners Association does that release the developers of all responsibility of repairing issues that were addressed prior to the transfer??

Obviously enough, the answers to your questions may very well depend upon the language contained in the Indentures, or Articles, or other documents setting up the Homeowner's Association and the transfer of various obligations from the developers of the sub-division to the Association. It would also be nice to see that piece of paper that the lady signed. Please consutlt with an attorney.
