homeowner's association

My mother recently passed away and we have her home on the market. We had an offer to purchase contingent upon the ability to install an invisible electronic pet fence. The homes association does not allow for fencing (in the traditional sense) Is it possible to challenge the homes association on the aesthetics of this when the fence is truly invisible to the naked eye?

Most homses associations have a mechanism for before the board to request a variance on specific restrictions. Yours sounds like a case for getting permission to violate the technical rules.
