Legal Question in Real Estate Law in Missouri
My husband and I are divorcing. We have lived in my fathers home with our 3 children for 8 years. My father does not occupy the property but is the sole name on the mortgage. We pay the mortgage payment which is currently late. He refuses to leave the property after the divorce is final. Legally can he do this. We are in Missouri.

Under the facts you describe, it should be up to your Dad to evict your ex husband. Unless you have a different agreement, it appears that you all have been renting the house, with the rent amount equaling the mortgage payment amount.
