Legal Question in Real Estate Law in Missouri

my husband and I were looking at a rent to own property. We filled out the credit and reference check then asked if we should put money down to hold it while the check was done. she said it would be a good idea. We put down $600.00 to hold it, only signed the credit and reference form, got a call saying we were approved, called back next day because we decided against it, now they do not want to return our $600.00 they say because they have taken it out of the paper. Are they in the right?

If it was a deposit, you are owed it back. If it was not, then you just rented that palce o\fro some time, so they have to let you move in. Just because they chose to take the unit out of the paper, doe snto seem top give rise to you forfeiting the entire deposit. But, you may have to ahve the cost of readvertsing the propeerty.

Good luck
