Legal Question in Real Estate Law in Missouri

limited power of attorney

I'm purchasing real estate in Missouri as a second home. I currently live in California. My wife and I will be holding title together. Unfortunately, my wife will be out of the country at the time of closing. I know I need a limited power of attorney document executed. Do I need one specific to Missouri or California?

There has been a movement to standardize power of attorney forms nationally. It has had some success at the legislative level, but at the street level, especially in small towns, familiar forms are more readily accepted. The best advice I've ever heard on this problem comes from an old-time mortgage broker I know. He says to ask the people who are going to be called upon to honor it -- maybe a title or escrow company, maybe it'll be the seller's lawyer. This should minimize the possibility of a glitch at closing.
