The owners that built a new house thats property abuts my moms has taken it upon themselves to cut grass and put a bench by the creek on Moms property. If they do this will they claim it is theirs because they are taking care of it.? They did not ask my mom, they have just made it an extension of their property

your mother can make a written letter thanking the neighbors for putting a bench on her property, and grant them an permission to use it, if they keep the area up. This may prevent them from ever getting an easement otherwise, or from making a claim for adverse possession. She can later revoke the easement or permission to use the land, if she wants. KEEP AGOOD COPY OF THE LETTER THAT SHE SENDS. IT MIGHT BE GOOD IDEA TO SEND IT BY CERTIFIED MAIL AND KEEP THE GREEN RETURN CARD WITH THE COPY OF HTE LETTER.

Good luck
