my neighbors damaged tree isleaning over my home have sked her about removing it with the severe weather we are having ithink she is not concerned as she has been told if it falls on my property it my promblem isn;t there something that says if she is aware of poten. danger it is then her responsibility

There may be times when you assessment would prevail in court. But, generally, if you know atree limb is hanging over your property, the onus is on you to remove it. If your neighbor's tree happens to have a branch growing over your property, they generally cannot prevent you from cutting it off at the property line. That is why it usually falls to you to remove nuisance branches.
