Legal Question in Real Estate Law in Missouri

Owner /Seller lied

We bought a home owner finaced 2 years ago, If the seller lied about the homes problems, which we are living everyday. He also lied about the home being owned by him free and clear, there was infact a bank loan.The attorney that drew up the papers stated there are no encumbrances. We also found out that the home had been on fire in which we were also not told about. We have been trying to sell the home and have been told by several that the home should have been condembed. and was cosmetically covered up. Which we have found out. The ceilings upstairs were covered with a ceiling paper in which started to fall, when tearing down the paper to put up something that could withstand the humidity, we found holes the size of basketballs. in which a black soot fell. WE hasked the sellers and was told no fire. we have recently found out that there had once been a fire. We cant sell the home because it is a small town and people know of the homes condition before the cosmetic cover up. Can we give the home back without him coming after us. We have paid him 17,000 and have put 10,000 in major repairs he left behind, What can we do?

Although not all of teh facts are included in your question, it appears that you may need to sue the seller and the attorney. Who did your title search for you? They should have caught the outstanding bank loan. This sounds like acase of fraud. Hire an attorney in your area to pursue this matter on your behalf. Noone can go into the intricate details of your matter yet, because they don't have enough of the intricate facts.
