Legal Question in Real Estate Law in Missouri

Property Damage and Trespassing

Do we have any recourse in regards to property damage and/or loss of enjoyment of our property in the following circumstance?

A construction crew began working on the home next door to us in February. We came home to find work began and our driveway (shared by us and the home in question) was destroyed and work had begun. We came home 2 weeks later to find that they had moved (drug) our boat, which was on our property ''out of their way''. We have since had to move the boat on to another part of our property that is not a driveway, thus destroying the grass there to save our property from any further damage. It is now June and no end in site to the work. The crew will tell us nothing and the property owner refuses to return phone calls. We were never notified, asked, told or anything that this work would be going on. We would like to sell our home but cannot due to the damage. What can we do?

Re: Property Damage and Trespassing

Put up a temporary fence with a "no trespassing" sign at the property line. The work crew will either ignore and you can call the police on them, and sue the company for the damages you have suffered. More likely the Construction workers will contact the property owner or owner of the cousntruction company. One of them will contact you.

If the property owner or construction company owner contacts you, tell them you want written agreement tht they will pay for the damages you have suffered, before you will allow them to use any of your property. Make sure you itemize the damages.

Good Luck
