questionable title company charges

On January 10, 2006 when I was closing an unrelated refinance transaction,I was charged $150.00 by a title co. on my sttlement statement for ''previous title work done'' dated Aug. 17, 2001 (4 1/2 years ago.) I did not order, authorize, or have any knowledge of this title search which was requested by an online broker whose only job at that time was to find a lender for me. I had sent this broker a legal description and warranty deed as proof of ownership which, unbeknown to me, he then used to request the title search. There was no commitment from any lender at this time. (I chose & closed with a local bank shortly thereafter.)

I was never billed by the broker or the title co. during the last 4 1/2 years. Now the broker and his company are nowhere to be found.

I paid the fee to the title co. under protest in order to complete my present transaction but strongly indicated that I challenged the insertion of this fee. The title co. refuses to refund my money because they cannot find the company or broker who ordered it. What can I do to get my money back? Small Claims Court? Do I have a case?
