Legal Question in Real Estate Law in Missouri
Rent Deposit
We moved out of our appartment complex in Ocotber of 06. In January of 07 we were contacted by an attorney stating we owed $867. The letter did not have an itemized list regarding these charges. When we contact the Apartment complex, they referred us to the Lawyer and would not answer any questions. We contacted that lawyer but they will not answer the phone. You have to leave a message and they call back. If we miss their call we have to do the same thing over again. Recently we were served papers to appear in court over this matter. I do not know what they are charging us for, it is just the amount. we have had no opportunity to dispute the charges. What should I expect when I go to court? Will they make me pay the whole amount? Is it worth getting a Lawyer to fight, the lawyer fee and amount I have to pay may end up more than the $867?

Re: Rent Deposit
If you do not admit that you owe the debt. You should file an Answer denying the allegations, and serve it on the attorney on the other side. There are probably lawyers in your area that will assist you in preparing a Pro Se Answer for you, for a fee that is lower than what they would charge to Enter their appearance. Also ask them how and whn you are to serve this on the other side.
If you do not want to go through all of that, you can appear in Court and state that you deny all the allegations. Ii will then be up to the Plaintiff or the Judge to set the matter for trial. Either way the Apartment complex will have to prove that you owe the money.
Good Luck
