If the seller buries the in ground pool prior to sale, do they have to disclose it during the sale?

There is no requirment to disclose. But, a selelr whop does nto disclose this fact coudl be subject to civil liability to the seller, and possibly cancellation of their protection from the title insurance policy. Why wouldn't a seller diclose that there is a pool?
