Legal Question in Real Estate Law in Missouri
signing a lease
I moved into an apartment that rented on a month to month basis and signed the agreement and moved in. Now the apartment complex has been sold and the new owners whant everyone on 6 mo or 1 year leases. My question is do I have to sign the lease, since I already signed an areement stating that I was on month to month. Wouldn't being forced to sign the lease be a breach of the contract that a previously signed?

Re: signing a lease
A month to month lease is a contract for one month's rent for your right to use the apartment. You and your old landlord agreed that you could stay their from month to month by paying rent the beginning of each month. A month to month agreement is basically a series of one month lease agreements. The landlord and you both had the right to terminate the relationship upon one month's notice.
The new landlord now has that right. They can give you a month's notice that they will no longer accept the month to month arrangement. Then they can offer you a 6 or 12 month lease option. This is not a breach of your "contract" as it expires whenever one party decides to give notice of not continuing.
