Legal Question in Real Estate Law in Missouri
Our subdivision has a contract with garbage co. Not everyone on the street uses this company. THe rate is supposed to be $14 per month they are charges us $21. We tried to cancel service but they say we can't. We ask for refund for being overcharged for 2.5 years. They said no. Can we do anything about it?

this sounds like a matter that you should first take up with your homeowner's association. Look at a copy of the agreemtn yourself, to make certain that the rate is $14, and nto subject o increase over time or change in fuel costs. If the garbage company charges you directly, as opposed to paying through yoru association, you can cancel the service. Before you do this, see if other garbage collectors are cheaper. Of the agreement says $14, don't overpay anymore. As to what you paid in the past, it may cost you more to sue them thorugh an attorney, then you would get back. You might be successful in small claims court.
