How does and unmarried couple split 2 rental properties?
My boyfriend and I are in an unfortunate situation. I want out of the relationship, but we have 2 (two family )properties that we both signed on. I have been the sole financial source for the past 4 years ( I have receipts). We currently occupy one apartment in one of the 2 properties. I offered him one of the buildings and he agreed, but he fails to leave, although I have paid every mortgage note on each property. What are my options? I want to be fair and give him one of the properties, but He won't leave. I even gave the suggestion to sell both properties and we go our separate ways, he won't budge. I want to move on with my life, but with this over my head, I can't. Please tell me what my options are.

I would suggest that you hire an attorney to send your boyfriend a written demand letter or settlement proposal, advising him that if he refuses to make arrangements voluntarily, a lawsuit will be filed. Quite often this will be enough to bring about a settlement. If not, it sounds like you would be able to file a lawsuit (called a "partition" suit) in the county in which the real estate is located. In such a suit, the court can ultimately Order the division of the property or the sale of the property and the division of the proceeds. Your financial contributions, and the living arrangements of the parties will be taken into consideration.
