Legal Question in Traffic Law in Missouri
clocked 4 1/2 miles before pulled over
ok. i got pulled over, and when the cop came to the window he told me he clocked me going 90 in a 70. he also told me that i probably did not see him because he was on the other side of the high way under a bridge 4 and 1/2 miles back before he pulled me over. there were tons of cars around both he and I on this high way, is that legal for him to clock someone across the high way with so many other cars around? especially saying i did 90 and i know i didnt get over 80.

There is nothing "illegal" about an officer clodking a driver from a distance. However, the farther away the officer is, and the more obstructions there are (other cars and concrete pillars and barriers) the weaker his argument is that he got an accurate reading of your true speed. He was honest on telling you that, and may have doen youa favor, by giving you another reason to have an attorney get it amended. If you got this ticket within twenty five miles of KC, I would be happy to work with you.

I can appreciate your concerns, but I believe that it is "legal" for an officer to clock you ender the circumstances you describe. The real question about it goes to rhe reliability of his testimony. It may be possible that he clocked another car or that other cars interferred with an accurate reading of your speed. basically, it comes down to going to trial and trying to beat the charge, or seeing if the prosecutor and judge might be willing to approve a plea bargain which would avoid a conviction and the resulting points against your record. Either way it does not look good for you. My advice would be to hire the best lawyer you can afford and follow that lawyer's advice. Good luck!
