Legal Question in Traffic Law in Missouri

Following too closely; lead vehicle slowed suddenly

I was cited for following another vehicle too closely; the vehicle was a state trooper. Situation: I had the cruise set at 65 (speed limit). The officer passed me. I pulled into the left lane to pass a slower vehicle. I saw a truck coming up behind me at a high rate of speed, so, I pulled back into the right lane after passing. The truck passed me, then pulled back over to the right lane and slowed down due to the trooper being in front (in the left lane). At this point, the truck had slowed (about 62), so, I pulled out to the left to pass. The trooper was in front of me. I was keeping an eye on the truck to determine when I was around it enough to pull back to the right. The trooper was slowing down while in front of me, down to nearly 60. While I was keeping an eye on the truck (in my mirrors), they slowed even more. I realized it, and tapped my brakes to slow. We were approaching a left turn lane, and approximately 50 feet before the turn (not the turn lane, but the turn itself), they turned on their left turn signal and braked to make the turn. I slowed, then went past them, they pulled back out to the road, and pulled me over. Should I fight this in court? This is the first time I have ever been pulled over.

Re: Following too closely; lead vehicle slowed suddenly

You did not indicate which jurisdiction this citation was from. however, since it is a moving violation, if you just pay the fine, your insurance rates may go up, and you may later have dificulties with your license from this incident. You may do well having an attorney get this amended to a non-moving violation. If you do not already have an attorney int eh area where you got the ticket, I may be able to assist you or refer you to someone who can.

Good Luck
