Legal Question in Traffic Law in Missouri

My wife was in a fender bender 2 years ago. The lady she hit was checked out by a doctor and released with nothing wrong. The damage to her vehicle was repaired. She is now sueing my wife for 25000 dollars. She claims to have numerous injuries and mental anguish from this fender bender. I was just curious if she could claim to have these injuries after such a long time even though the doctor said she had nothing wrong? How is the best way to handle a situation like this? Should it be a hard case to handle?

Your wife probably had liability insurance in effect at the time of the collision. Her insurance carrier will in all likelihood hire an attorney to handle the case. If you have not already turned over the suit papers to the insurance company, you should do so immediately. It is not unusual for a person to file a suit for personal injuries many months after the collision. Sometimes it takes a while for the injuries to manifest themselves, and in other cases the person just waits until they are discharged from treatment to file a lawsuit. In some cases it may be that the other person's attorney has been trying to settle the matter with your wife's insurance company but has been unable to do so. I have represented many people on either side of such lawsuits, and your attorney will be certain to develop any evidence which might indicate that the woman bringing the lawsuit was not injured. Most cases of this type are not extremely difficult, but each case is unique and presents its own particular problems. I am very confident that the attorney provided by the insurance company will do a competent job. All your wife and you have to do is give your attorney your full cooperation. Good luck.
