Legal Question in Traffic Law in Missouri

driving on shoulder slippery road

While traveling on 50 Hwy from Sedalia, Mo to Lone Jack, Mo. the roads wre icyand snow covered. It was a prudent call (judgment call) to straddle the shoulder to offer safety to myself and to other drivers. Deputy asked me why I was driving on the shoulder and I told him for safety. I thold him the following: ''I drove 35 MPH while other traffic passed me at speeds typically ranging from 50 to 60 MPH. I drove partially on the shoulder straddling the right white line with half of my car in the slow lane and the right half of my car on the shulder. He gave me a careless and imprudent driving ticket. Help.

Re: driving on shoulder slippery road

As you said, it was a judgement call. Both for you to choose to drive half off the road, and for the officer to say it was C&I. Perhaps an attorney could convince the prosecutor not to push the issue and agree to let you plead to a lesser offense.

If you have an impending court date, you should hire an attorney very soon.

Good Luck
