Legal Question in Traffic Law in Missouri
Inaccurate info on speeding ticket..
I was given a ticket for 64 in a 40 zone. It is actually a 45 mph zone which I told the officer when he asked me. He disagreed and wrote 40 mph zone anyways even though there were two speed limit signs facing both ways and 30 feet away from where he was set up. Not only is it actually 45 mph zone but where I was clocked and where the officer said it happened was is a 1/4 mile difference and not even in view. Is this possible grounds for dismissal?

Re: Inaccurate info on speeding ticket..
I cannot fully answer your question without more detail regarding the method used to measure your speed, the location of the measurement related to the stop, etc. My first impression, though, is that the irregularity between the posted speed and the officer's entry needs to be verified and corrected at a minimum. The distance between where he clocked you and where you were pulled over may be relevant, but it is essentially your word against his, and officers are usually believed. In general, depending on your driving record, you could make a deal for a lesser charge to avoid this ticket going on your record, and avoid the points on your license. A dismissal is possible, but regardless of the posted speed, you were still speeding.
