Legal Question in Traffic Law in Missouri

already pled guilty - traffic

My hubby was charged with some crimes he did not commit and we could not afford a lawyer. While in lockup they told him he had to plead guilty because if he pled not guilty he could sit there for a year while they investigated. They said if he pled guilty he could get out that day. Now he has 2 years of probation and a large fine to pay that he did nothing to deserve. Is it too late?

It may not be too late for your husband to request that the judge set aside his guilty plea. He or you should hire an attorney ASAP to get the ball rolling. The facts you describe, may cause a judge to set aside the plea and alllow him to contest the evidence at trial. This does not mean he will win at trial. you have not provided enough facts to even venture a guess at that. you said before that you could not afford to hire an attorney. Now, can you afford not to?

Anthony Smith hit it on the head again! How long ago was this plea? When did you first come to believe that pleading guilty was a mistake? Depending on the facts, and other factors, it might be possible to set aside the plea and either proceed to trial or negotiate a better disposition. It will be more expensive and much more difficult to deal with this now then it would have been if you had been able to borrow or come up with money to hire an attorney in the first place, but I believe that it is the only option for you. Hire an attorney.
