Legal Question in Traffic Law in Missouri

Having someone's license suspended

I recently won a small claims case and have tried to make arrangements with the other party to pay off the debt with no success. I was told I can have their drivers license suspended and/or their property taken to pay off the debt. Is this true and how do I go about it? The debt is a considerable amount.

Thanks.

Re: Having someone's license suspended

Unless the Judgment was for an automobile accident wherein the Defedant has no insurance, you are not likely to ever get someone's driver's license suspended for a small claims judgment debt. As to executing on personal property of the Judgment debtor, it may be possible, but tricky. You may want to hire an attorney to get your case set up for a Hearing In Aid (of execution). This is where your have the Court make the other person come to Court and tell you what personal property they have( i.e. homes, cars boats, bank account, etc.). There are forms that you can downlaod to get the ball started. However, I have not seen a pro se Plaintiff succeed in getting useful information. The whole idea is to find a way to collect on the judgment, not to harass the defendant.

Good Luck
