Legal Question in Traffic Law in Missouri
My wife received a ticket for going 40mph in a 30mph (school zone) in which the sign states 6:30am - 5:00pm school days. This particular week, our school district was out on spring break and there were no activities at the school. the police officer also wrote down on the ticket, the wrong ord#. What he wrote was related to a different section of roadway and had nothing to do with this school zone. Is there a ruling on what is considered a school day? Are holidays and breaks included? Do we have a leg to stand on. Thanks for any help.

You may raise the fact of spring break in your defense as to the issue of what the court considers a school day. There are not enough facts available here to determine if it will be successful. If the court does not agree with your wife's opinion as to what constitutes a school day, employ counsel to represent her. The cost may be more than offset by the future savings in insurance premiums.
