Legal Question in Traffic Law in Missouri

Wrong name on ticket

I was pulled over for speeding going 70 in a 60 zone, and was written two tickets, one for the speeding and the other for not signaling when I pulled over to the side of the road. On the tickets, my name is spelled two different ways, and they are both incorrect. I have been told by more than one person that this means the ticket is technically not written to me and therefore, not enforcable. I was just wondering if this is true.

Re: Wrong name on ticket

You were very wise to seek a professional opinion from an attorney and not rely upon the incorrect advice of your friend. The mis-spelling of your name on the tickets does not make them unenforceable at all. First of all, the officer probably has your driver's license number or social security number so they can easily determine who you are. Second, the prosecutor has the authority to "amend" or "correct" the mis-pellings on the tickets. I would strongly suggest that you hire an attorney in your area to help you with these tickets. You do not want to take a conviction if you can help it, and these types of charges are usually amendable. If you are in the Eastern part of the state and are not already represented by legal counsel you may call me for a free telephone consultation at 314-727-2822.
