Legal Question in Wills and Trusts in Missouri

Beneficiary Deed

My sister received benefits from Missouri for social security and medical for 9 years. She died this year. I am listed as beneficiary on her deed. Can Missouri claim the property to recover some of the benefits paid?

Re: Beneficiary Deed

When did your sister name you as the beneficiary on her beneficiary deed? I believe that there is a five year look back period for the government to try to recover payment of benefits, but I would have to research the Missouri law on the topic in order to give you specific legal advice. I do know of cases allowing the government to make such a claim against real estate that was the subject of a beneficiary deed, but these cases are very fact specific and without knowing all of the facts and researching the law I can not tell you whether you will be subject to such a claim. You should definitely consult with an attorney to learn exactly what your legal position is on this matter. Good luck.
