Legal Question in Wills and Trusts in Missouri
boyfriend passed away, left me in his will
There was a falling out between me and his family before his death. I cared for him for 2 years with no help from them. We did not live together but had a 10 yr relationship. He named me as the person to get his house and money for payments. I believe the house has been sold. If I was not removed from his will before his death am I still entitled to anything and would I be notified or should I look into this matter myself or will I be wasting my time with this? I heard he passed away in April of this year. He was living with his brother in Kansas at that time of his death. His brother had Power of Attorney.

I agree with the attorney who posted a response a bit earlier. Where was the real estate located? If it passed through his probate estate, there must be something filed in the probate court in the county where the property was located. It is also possible that the Will was filed in the county where he died, at least initially, so you might want to check with the probate court in that county. If the Will was never filed, you may be able to file a Petition to force the person who has the Will to file it. Then it will be a matter of public record, and either you or your attorney can review it to see if it had been changed. Depending upon how much you stand to inherit, it probably makes the best sense to hire an attorney.

You should look into this, or hire an attorney to do so. If his Will was not admitted for Probate, then it will not be followed. You need to make sure his will is admitted (submitted) to the probate court, so his wishes will be followed.
